Pink Floyd & EMI in legal tussle

Pink Floyd, the band behind Dark Side of the Moon, one of the best-selling albums in music history, have filed a lawsuit against EMI, claiming the private equity-backed firm has miscalculated royalty payments.

The unprecedented legal claim is a glimpse at the fraught relationship between EMI, under the ownership of Guy Hands’s Terra Firma, and some of the label’s leading acts. The new owner’s arrival in 2007 was blamed for the departure of acts such as Radiohead and Paul McCartney.

Terra Firma acquired stock market-listed EMI for just over £4bn, saddling it with £2.5bn of debt in the process. Hands, who became chairman, quickly moved to cut costs.

Industry insiders suggest the legal action is likely to have flared up amid routine three-yearly negotiations over royalty payments.

Pink Floyd, who signed with EMI in 1967, have been one of EMI’s most lucrative signings. In the last 25 years their back catalogue has only been outsold by that of the Beatles.

EMI and Pink Floyd declined to comment.


The Guitars
Gilmour's main stage guitar is a USA 57 Vintage Reissue Strat fitted with EMG-SA pickups. He has also installed the EMG-EXG expander & SPC midrange presence controls. Apart from the electrics, the only other custom feature is a shortened tremolo arm so that he can keep it in his picking hand more comfortably while playing. Other guitars used live are an Esquire Telecaster in dropped D tuning for Run Like Hell, two Jensen lap steel guitars one tuned to E B E G B E for One Of These Days & the other tuned to D G D G B E for The Great Gig In The Sky. He also uses two Gibson J-200 Celebrity acoustics one tuned in standard & the other in D A D G A D for Poles Apart & a Gibson Chet Atkins Electro Classical. Both the Jensen Lap Steels & the acoustic guitars are fitted with EMG-H pickups. (These are basically a single coil pickup in a humbucker cap).


Pink Floyd were a psychedelic/progressive rock band formed in Cambridge, England in 1965. They are one of rock’s most successful and influential acts, having sold over 300 million albums worldwide. The band’s classic lineup was Roger Waters (vocals, bass), David Gilmour (vocals, guitar), Rick Wright (organ, keyboards, vocals) and Nick Mason (drums). Gilmour was brought into the band in 1968 to replace the band’s founder, singer, guitarist and songwriter Syd Barrett, who had become increasingly erratic and departed from the band a few months after Gilmour’s addition. more
